Terms and Conditions – Iguanaride Curacao
These Terms and Conditions apply to all participants going on our tours and can be viewed and downloaded from our website. You may also request a printed copy at our offices.
Security Deposit
No security deposit is required. However, if any damage occurs to scooters or accessories while in the possession of the customer, the customer is required to cover all associated costs as indicated in these Terms and Conditions and our Waiver.
Weather Conditions
Iguanaride Curacao will not depart in unsafe weather conditions. Our staff will assess the weather, and should the staff determine that the conditions are unsafe to carry out a tour, the tour may be postponed or canceled.
Every effort will be made to reschedule your tour during your stay. If you are unable to reschedule your tour, we will refund you.
Reservation and Boarding Information
For tour activities, please arrive at least 15 minutes prior to the scheduled start time.
A valid driver's license or National ID is required for all tours for participants aged 18 years and older, where applicable.
Participants
Must have a valid driver's license or National ID to book a tour, where applicable.
All drivers must be 16 years or older to book a tour on their own.
All persons involved with our activities/tours acknowledge that said activities/tours are potentially dangerous and agree to hold Iguanaride Curacao, its owners, employees, and affiliated properties harmless to the extent permitted by law.
Payment Policy
Iguanaride Curacao accepts cash, debit cards, and major credit cards (MasterCard, Visa, Discover Card, and American Express) for identification and payment for selected tours.
All payments for online or walk-in reservations must be made in full at the time of reservation, subject to the Cancellation Policy.
In cases where a customer is eligible for a refund, the refund will be made using the same method of payment used for the reservation, whether by credit card, cash, or wire transfer, at the discretion of Iguanaride Curacao.
Cancellation Policy
As a courtesy to fellow customers, kindly cancel any reservation that is no longer needed if your plans change, and do so as soon as possible.
Cancellation 48 hours or more prior to the activity starting date: Full refund.
Cancellation between 48 and 24 hours prior to the activity starting date: 50% refund, regardless of the reason.
Cancellation within 24 hours of the reserved date: No refund of any kind, regardless of whether or not the equipment is re-booked by another party.
No Shows: Charged in full for the tour.
Any party that has not arrived by the scheduled tour time shall be deemed a NO SHOW.
We reserve the right to cancel a reservation for violations of our policies.
We reserve the right, solely at our discretion, to reschedule and/or cancel a reservation in the event of inclement weather or any situation that may pose a threat to the safety of our customers and/or staff.
Reservations canceled due to weather, or any other valid and approved reason, during the tour period will be offered a new tour date and time.
The customer may also choose a suitable date and time within our regular scheduling. However, it is solely the decision of Iguanaride Curacao to determine whether the proposed date and time are suitable.
Damages
The customer shall notify Iguanaride Curacao immediately of any and all accidents and damage resulting from the use, operation, or riding of the scooter.
The customer agrees to pay all costs, expenses, and attorneys' fees incurred by Iguanaride Curacao in collecting sums due, regaining possession of equipment, or enforcing or recovering any damages, losses, or claims against the customer.
The customer agrees to inform Iguanaride Curacao immediately of any defect or malfunction while the equipment is in use.
Once notified, Iguanaride Curacao will assess whether the scooter is still fit to operate for the remainder of the tour.
At no time should the key(s) be left in the equipment unattended unless instructed by one of our tour guides.
The customer is responsible for the loss, theft, damage, or destruction of the equipment and agrees to pay the full replacement value of the item(s), with a minimum charge of USD 75.00, payable by cash, credit card, or debit card.
If an electric scooter is damaged beyond repair, the customer agrees to pay Iguanaride Curacao a total sum of USD 850.00 immediately for an equivalent replacement.
The customer also agrees to authorize Iguanaride Curacao to charge the replacement cost of damaged or lost item(s) to the customer's credit card provided, if applicable.
The customer agrees to return all rental item(s) and accessories, including but not limited to helmets and batteries, in the same condition in which they were delivered.
Refunds
All refunds will be made using the method of payment used for the reservation, by cash or wire transfer at the discretion of Iguanaride Curacao.
All refunds will be processed within 7 bank days after the originally booked tour date.
There is NO early return refund.
There is NO refund for customers who are unable to participate due to their lack of ability to operate the scooter.
There is NO refund if a customer misses their tour due to late arrival.
Every attempt will be made to reschedule the tour, but this will be based on availability and at the discretion of our staff member(s).
The new rescheduled date must be within 48 hours of the original tour date.
If an agreement cannot be reached based on the staff member's proposed alternative, the customer is NOT eligible for a refund.
Iguanaride Curacao reserves the right to rent out the equipment to an alternative customer if the original customer returns the equipment or is unable to depart, regardless of the reason, and Iguanaride Curacao is NOT obligated to refund or credit the original customer under these circumstances.
Insurance
Iguanaride Curacao equipment is insured under WA (Third Party) insurance. This insurance only provides coverage for damages to other vehicles or properties and does not cover damage to Iguanaride Curacao's own equipment.
In the event of an accident, if the customer is at fault, the customer is responsible for any and all damages occurring to the scooter(s), persons (including the customer and passenger), and rented equipment, to the extent permitted by law and subject to the applicable insurance coverage.
The customer agrees to pay all costs, expenses, and legal fees incurred by Iguanaride Curacao in collecting sums due, regaining possession of equipment, or enforcing or recovering any damages, losses, or claims against the customer.
Iguanaride Curacao reserves the right to amend these Terms and Conditions when necessary. The latest version published on our website shall apply to all bookings made after its publication.
